AiJiv Privacy Policy

AiJiv Inc. ("AiJiv," "we," "us," or "our") values your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you access or use our platform and related products, services including AI agents, creator clones, AI voicebot service, AI chatbots, other tools and features which may contain data in uploaded knowledge bases, content, user conversations etc. ( collectively, "Services"). This policy applies globally and is intended to be consistent with applicable privacy laws, including the DPDPA, Australian Privacy Act, GDPR and the CCPA. Wherever a jurisdiction specific statutory obligation is inconsistent with the policy, the statutory obligation shall prevail.

AiJiv.ai is a product owned solely by Cyberhuman.Ai, Inc. All rights, title, and interest in and to AiJiv.ai are exclusively held by Cyberhuman.Ai, Inc. Any references to 'AiJiv,' 'we,' 'us,' or 'our' throughout these Terms refer to Cyberhuman.Ai, Inc. as the sole owner and operator of AiJiv.ai and its associated Services.

This Privacy Policy works together with our Terms of Service, Community Guidelines, and Copyright Policy. Please review them alongside this policy to fully understand how the Services operate.

1. Information We Collect

We collect information to provide and improve the Services. The categories below describe the types of information we may collect:

  • Personal information: name, email address.
  • Interaction data: questions and responses exchanged with the AI voicebot, AI chatbot, timestamps, and related metadata.
  • Device information: device type, operating system, browser type, IP address, and language settings.
  • Log files: automatically collected details about your interaction with the Service (pages viewed, session durations, error reports).
  • Cookies and tracking technologies: small files stored on your device to save preferences and analyze usage, where permitted by law.

When you make a purchase or sign up via a third-party operator, we may receive information necessary to enable your access, such as:

  • Your name
  • Email address
  • Phone number (if provided)
  • Preferred language
  • Payment-related details (amount, date, transaction metadata)

  • Including personal data present in in books, manuscripts, articles, templates, frameworks, teaching materials, coaching materials, PDFs, DOCX files, TXT files, transcripts, audio, video, websites, and other knowledge base materials uploaded, linked or otherwise provided by the Creator.

  • Including personal data present in questions, prompts, responses, outputs, conversation history, timestamps, session information, feedback, ratings, metadata and any information voluntarily provided by users when interacting with the Creator’s Agent.

2. How We Use Your Information

We use personal information for the following purposes:

  • Provide, operate, and maintain the Service. We will not use any personal data of the Creator for this purpose.
  • Personalize and improve the Service, including reining AI responses.
  • Communicate with you about account updates, support requests, and service changes.
  • Perform analytics to understand usage trends and improve performance.
  • Comply with legal obligations and protect against fraud and abuse.

We do not sell your personal information.

3. Cookies and Tracking Technologies

We use cookies and similar technologies to: Save user preferences and settings.

Analyze traffic and Service performance. Tailor content based on user behavior.

You can manage cookie preferences in your browser settings, but disabling cookies may limit Service functionality.

4. Sharing Your Information

We share personal information only as described below:

  • With affiliates: to enable integrated services and internal analytics. We will share this list upon request.
  • With trusted third-party service providers: hosting, payment processors, analytics, and technical support providers who are contractually bound to safeguard your data, as identified in our policy and updated from time to time. We will share this list upon request.
  • For legal reasons: where required to comply with law or to protect our rights, property, or safety.

5. Leaving Our Website

We may provide links to third-party sites are provided for convenience. Their privacy practices are governed by their own policies; review them before providing personal information.

6. AI Training and Model Improvement

We may use information included in uploaded files, prompts, outputs, embeddings, vector data, retrieval data, Agent configuration, user conversations, transcripts, analytics, and related data to train, fine-tune, evaluate, and improve our AI models, including the general AiJiv model and platform-wide systems, subject to the following:

  • Where reasonably feasible, we will de-identify or anonymise personal information before using it for training purposes.
  • We will not share personal information with unaffiliated third-party AI model providers for their independent training purposes without separate notice.
  • Users may opt out of having their data used for model training by [adjusting settings / contacting us], and we will honour such requests on a prospective basis.
  • We will process personal data for training purposes in accordance with applicable data protection law, including any required legal basis, notice, or consent obligations under the DPDP Act, GDPR, or other applicable regimes.

7. Data Retention

We retain personal data only as long as necessary for the purposes described in this policy, or as required by law. When data is no longer required for the purposes for which it was collected or processed, we delete or anonymize it.

Upon termination of the Creator Agreement, deletion of the Creator’s Agent, or written deletion request from the Creator, we will actively delete personal data from active systems, subject only to limited retention strictly required for legal, regulatory, security, fraud prevention or final accounting purposes. Where a Creator or User has requested deletion, we will confirm the deletion in writing.

8. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal data. Below are common rights under the GDPR and CCPA.

If you are in the EU/EEA or UK, you have rights including:

  1. Right to Access: Request confirmation whether we process your data and obtain a copy of such data.
  2. Right to Rectification: Request correction of inaccurate or incomplete data.
  3. Right to Erasure (Right to Be Forgotten): Request deletion when processing is no longer necessary or consent is withdrawn, subject to exceptions.
  4. Right to Restrict Processing: Request restriction in certain circumstances (e.g., while accuracy is being verified).
  5. Right to Data Portability: Receive your data in a structured, machine-readable format and, where feasible, request transfer to another controller.
  6. Right to Object: Object to processing based on our legitimate interests or for direct marketing.
  7. Right to Withdraw Consent: Withdraw consent where processing is based on consent (without affecting prior lawful processing).
  8. Rights Related to Automated Decision-Making: Request human intervention or limits on automated decisions, where applicable.

  4. Right to Opt Out of Sale/Sharing: While we do not sell personal data, you may opt out of any sharing for cross-context behavioral advertising.

In the past 12 months we may have collected categories such as identifiers, internet activity, geolocation (if applicable), and inferences for personalization. We do not sell or share personal data of minors under 16 without authorization.

Data Security

We implement industry-standard security measures (encryption, secure hosting, audits) to protect personal data. No system is completely secure, but we strive to maintain strong protections.

Among the security features that we use to protect your personal data, we may require you to create and use a username and unique password to access the AiJiv. We use multiple layers of security to protect your personal data. We, at minimum, maintain security controls to protect your personal data including encryption, obfuscation, masking, access controls and audit logs, maintaining comprehensive internal security documents, backups and business continuity measures, security incident remediation mechanisms etc.

9. International Data Transfers

Personal data may be transferred to countries outside the EEA/UK (including the United States). Where transfers occur, we implement safeguards such as:

  • Standard Contractual Clauses (SCCs) where required.
  • Transfers to jurisdictions with an adequacy decision when applicable. Supplementary technical and organizational measures (encryption, minimization).
  • Wherever applicable under local law, we will restrict transfer to jurisdictions where such transfer of personal data is restricted or prohibited as per applicable law.

10. Children’s Privacy

The Service is not intended for individuals under 13 (or the local minimum age). We do not knowingly collect personal information from children; if we learn of such collection we will delete the data.

11. Grievance Redressal

If you are not satisfied with our response, you may have the right to lodge a complaint with your local data protection authority, depending on your jurisdiction, in accordance with applicable data protection laws.

12. Changes to This Privacy Policy

We may update this policy from time to time. Changes are effective when posted with a revised "Effective Date." Continued use of the Service after changes indicates acceptance.

14. Jurisdiction-Specific Provisions

Definitions

  • "applicable data protection law" the DPDPA and any rules, regulations or guidelines issued thereunder.
  • "data principal" means the individual to whom the personal data relates and where such individual;
  • "data fiduciary" means any person who alone or in conjunction with other persons determines the purpose and means of processing of personal data;
  • "processing" in relation to personal data, means a wholly or partly automated operation or set of operations performed on digital personal data, and includes operations such as collection, recording, organisation, structuring, storage, adaptation, retrieval, use, alignment or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction.

Legal basis for processing data

In some cases, as permitted under the DPDPA, we may rely on legitimate use grounds or exemptions as a legal basis for processing your personal data. Where we cannot rely on legitimate interests, legitimate use grounds, or other applicable legal exemptions to process your personal data, we will obtain your consent before carrying out such processing.

Age restrictions

We do not knowingly track, monitor behavior, or engage in targeted advertising directed at children (i.e., individuals under the age of 18), in accordance with applicable laws. If we become aware that personal data of a child has been collected or processed in violation of any legal requirements, we will take appropriate steps to delete such data and ensure compliance.

Rights of Users

In addition to other rights set forth in this Policy, you have the right to contact AiJiv to obtain a summary of your personal data being processed and the related processing activities.

You have the right to contact AiJiv to nominate another individual, who may, in the event of your death or incapacity, exercise your rights under this Privacy Policy and under the DPDPA and implementing regulations.

Grievance Redressal

If you have any questions or complaints regarding the processing of your Personal Data in India, or if you want to receive this Policy, please contact grievance@cyberhuman.ai. We will endeavor to address your grievance within a reasonable period of time and, in any event, within 90 days from the date of receipt of the complaint. If we are unable to address your complaint or grievance, then you have the right to escalate the matter to the Data Protection Board of India.

Transfer of Data

AiJiv may transfer your Personal Data to third parties or service providers located outside your jurisdiction. We ensure that any such transfers comply with applicable laws. Where authorities restrict transfers to certain countries or territories, we will adhere to those restrictions and take appropriate measures.

We do not collect any Protected Health Information defined under HIPAA for provision of our services.

Where applicable Australian privacy laws apply to our collection, use, disclosure, storage or other processing of your personal information, we will handle your personal information in accordance with such laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Disclosure and overseas transfers

We may disclose your personal information to our affiliates, service providers, subprocessors, infrastructure providers and other third parties that assist us in providing AiJiv. Your personal information may be stored, processed or accessed outside Australia. Where required by applicable law, we will take reasonable steps to ensure that overseas recipients handle your personal information in a manner consistent with applicable Australian privacy requirements. Where practical, we will identify the countries where data is being transferred under this section.

Where any personal data breach is likely to result in serious harm, we will notify you in accordance with applicable breach principles under Australian privacy laws.

You have a right to opt out of direct marketing communications. Wherever applicable, you may choose to interact anonymously or use a pseudonym.
